1. Agreement and operator
These Terms form an agreement between you and Paolo Ronco, operator of OrbitPage from Italy. By creating an account, starting a subscription or using the managed service, you accept these Terms together with the Acceptable Use Policy and, for paid plans, the Billing & Cancellation Policy. Where OrbitPage processes personal data on your behalf, you also accept the Data Processing Agreement, which prevails if there is a conflict about that processing.
If you use OrbitPage for an organisation, you confirm that you have authority to bind it. If you do not accept these documents, do not use the managed service.
2. Managed service and open-source edition
Managed OrbitPage provides account administration, an editor, reviewed AI page editing, Automation API and connected-client access, hosted pages, menus and additional pages, partner blocks, wallet passes, storage, plan controls, security, analytics, newsletters, Shop and custom-domain features according to the active plan. The open-source OrbitPage application is separate and is licensed under the MIT licence in its public repository. These Terms do not replace that software licence or make OrbitPage responsible for independent self-hosted deployments.
3. Eligibility and accounts
You must be at least 18 years old or otherwise legally able to enter this agreement. You must provide accurate information, verify your email when requested, protect your sign-in method and promptly report suspected unauthorised access. You are responsible for activity performed through your account unless caused by OrbitPage's breach of duty.
Usernames and hosted slugs are allocated on a first-confirmed basis, must be unique and may not impersonate another person, misuse a protected name or violate the Acceptable Use Policy. OrbitPage may reserve or reassign names where legally required, needed for platform operation or necessary to resolve a documented rights dispute.
4. Your content and licence to operate the service
You keep ownership of content you submit. You grant OrbitPage a worldwide, non-exclusive, royalty-free licence to host, copy, transform for technical delivery, cache, display and transmit that content solely to operate, secure and improve the service and to comply with your publication instructions. The licence ends when the content is deleted, subject to backups, caches, legal retention and copies made by third parties.
You confirm that you have all rights, permissions and lawful bases needed for your content, media, personal data, trademarks, links, embeds and connected domains. You remain responsible for statements and offers made on your page.
5. Public pages and third-party integrations
Published pages are intentionally public and may be indexed, shared and cached. Partner blocks can display or link to independent services including social networks, video and audio players, maps, calendars, booking tools and forms. Supported providers can change their APIs, policies or embed availability without notice to OrbitPage.
You are responsible for every URL and provider you select, for having permission to display the material, and for providing accurate privacy notices and lawful consent settings. OrbitPage blocks consent-gated embeds until the visitor grants the configured category, but does not control a provider after its content loads or a visitor opens its link. Provider names and logos identify compatibility only and do not imply sponsorship, endorsement or partnership.
Custom domains depend on your registrar, DNS configuration and Cloudflare's certificate and hostname validation. OrbitPage cannot guarantee a domain that you do not control or a specific propagation time.
If you enable an external consent manager, Cal.com booking lifecycle integration or a Wallet pass, you are responsible for having the provider account, notices, instructions and rights needed for the transferred data. A Wallet pass represents public page information at the time it is issued and is not an identity credential, ticket or payment instrument unless a separate offer expressly says so.
6. AI, Automation API and connected clients
The authenticated AI editor can answer questions and propose changes using your instruction, recent conversation and current page context. AI output can be incomplete or inaccurate. You must review every proposed change, source, claim, price, legal statement and destination before applying or publishing it. OrbitPage does not apply an AI proposal without your confirmation and the AI editor is not legal, medical, financial or other professional advice.
Personal Automation API tokens, OAuth grants, MCP clients and ChatGPT connections act with the workspace and scopes you select. Protect raw tokens and connected accounts, grant the minimum permissions, review tool results and revoke access you no longer need. You must not use automation to bypass review, permissions, moderation, plan limits or this agreement. A third-party client is governed by its own terms and can retain the data you direct OrbitPage tools to return.
7. Plans, limits and changes
Each plan can limit blocks, upload size, storage, themes, analytics, branding, collaborators, domains, newsletter subscribers, monthly email attempts, moderation checks and other resources. The limits shown on the pricing page, at checkout or in the dashboard form part of the service. OrbitPage may reject, compress, remove or prevent data that exceeds the active plan.
OrbitPage may change or retire features and plan limits to improve the service, respond to security or legal requirements, or keep the service economically sustainable. Material adverse changes to a paid plan will be communicated in advance where reasonably possible. Mandatory consumer rights remain unaffected.
8. Newsletters and customer SMTP
Paid newsletter features require an SMTP account that you are authorised to use. You are responsible for its availability, charges, sending limits, sender-domain authentication and provider terms. OrbitPage encrypts the submitted password and uses it only to verify the connection and send messages you configure.
You must have a lawful basis for every recipient, keep evidence of consent where required, identify the sender accurately and honour unsubscribe requests. Do not use purchased, scraped, guessed or stale lists. Generic SMTP acceptance does not guarantee inbox delivery; open and click reports are approximate because privacy tools and automated scanners can affect them.
9. Tenant Shop and connected payments
Shop is currently limited to eligible plans, EUR pricing and digital products or services. If you enable it, you are the seller and merchant responsible for every listing and transaction. Before publication you must complete and certify the public seller profile, including trader status, geographic and electronic contact details, applicable business or tax identifier and HTTPS links to your current terms, privacy, refund and withdrawal information. You must keep that profile accurate and must accurately describe the offer, price, availability, delivery and service conditions. OrbitPage provides storefront, checkout integration and delivery automation and is not the seller or a party to the sale between you and your customer.
Shop payments use a Stripe connected account in your name and direct charges on that account. Stripe collects business, identity, payment and payout information, controls eligibility for payment methods and charges its own processing fees. OrbitPage retains a platform fee equal to 5% of each successful Shop payment. The connected account receives the remainder after applicable Stripe and OrbitPage fees and remains responsible for refunds, disputes, chargebacks and any balance obligations under its Stripe agreement.
Every Shop buyer must actively accept the seller's terms before Checkout. For digital content, OrbitPage separately requires the buyer's express consent to immediate supply and acknowledgement that the withdrawal right is lost once download begins, and includes that record and seller-policy links in the order email. You must not alter, obscure or contradict that flow and must provide your own compliant withdrawal function or contact where required. For services, you remain responsible for any express request to begin during a withdrawal period and for proportionate charges or refunds required by law.
When OrbitPage processes a full or partial refund through the integration, it returns its application fee in full or proportionally. Stripe fees may not be returned and are governed by Stripe. Digital delivery links expire after 30 days and permit a limited number of downloads. You must maintain your own source copy and customer support channel; OrbitPage does not warrant that a buyer will retain indefinite access after expiry, account closure or lawful removal.
10. Paid subscriptions
Paid plans are billed through Stripe at the price, currency, billing interval and tax treatment shown before checkout confirmation. Subscriptions renew automatically until cancelled. Checkout requires active acceptance of the OrbitPage Terms and records the applicable legal version. The acceptance text expressly requests immediate plan activation during the 14-day consumer withdrawal period and explains that a proportionate amount may be due for service supplied before withdrawal. Stripe stores and processes payment credentials; OrbitPage receives subscription, invoice and payment status rather than full card details.
Plan changes, payment methods, invoices and cancellation are managed through the dashboard and Stripe Customer Portal. Cancellation normally takes effect at the end of the current paid period. Refunds, failed payments and EEA consumer withdrawal rights are described in the Billing & Cancellation Policy; an eligible withdrawal can be submitted through the online withdrawal function.
11. Acceptable use and reports
You must comply with the Acceptable Use Policy. In particular, do not use OrbitPage for unlawful content, abuse, fraud, malware, rights infringement, deceptive impersonation, unauthorised security testing, spam or evasion of technical and plan limits.
Anyone may report suspected unlawful or prohibited content through the contact page. Reports should identify the exact URL and content, explain the legal or policy basis, include supporting information and contact details and contain a good-faith declaration that the information and allegations are accurate and complete.
12. Moderation, suspension and appeals
OrbitPage may use automated and manual checks and may block publication, remove content, restrict a feature, suspend a public page or terminate an account where reasonably necessary to enforce these Terms, protect users or infrastructure, respond to a credible rights claim or comply with law.
Where required, a restriction notice or statement of reasons identifies the relevant facts, contractual or legal basis, territorial scope and duration, whether automated means materially contributed, and the available internal review or external redress. Notice may be limited where prohibited by law, necessary for a criminal investigation or justified by repeated manifestly illegal content. Urgent action can be taken without advance notice. Account holders may contest a decision and request human review by contacting contact@orbitpage.com.
13. Intellectual property
OrbitPage's hosted platform, service design, brand, documentation and non-open-source components are protected by intellectual-property law. Except for rights expressly granted by the applicable open-source licence, you may not copy, resell, reverse engineer, remove notices from or create misleadingly branded versions of the managed service.
14. Third-party services
The service depends on platform providers including Firebase, Vercel, Cloudflare and Stripe. Page owners can also choose independent partner services for social content, players, maps, bookings and forms, and can choose their own SMTP provider. Those services and external websites are governed by their own terms and can change, restrict or discontinue access. OrbitPage is responsible for selecting and managing its processors as required by law, but is not responsible for page-owner selected providers, third-party content or failures entirely outside its reasonable control.
15. Availability and changes
OrbitPage is provided on an as-available basis without a guaranteed uptime service level unless a separate written agreement says otherwise. Maintenance, security work, provider incidents, internet failures and events beyond reasonable control can affect availability. OrbitPage may release, test or withdraw features while preserving paid access and mandatory rights as required by law.
16. Ending the agreement
You may stop using the service and cancel a paid subscription at any time. You may permanently delete the account and hosted workspace from Dashboard > Account after confirming your identity. This removes the public page and slug, active workspace content and uploads, Shop catalog and delivery files, connected domain route, active OrbitPage subscription relationship and Firebase login. Narrow billing, Shop order, consent, withdrawal, safety or legal-claim records can remain for the periods disclosed in the Privacy Policy, and Stripe can retain connected-seller and regulated transaction records under its own terms. Outstanding Shop refunds, disputes, taxes, fulfilment and buyer-support obligations remain the seller's responsibility. Export a backup first if you intend to transfer the page to another account.
OrbitPage may terminate the agreement for a material or repeated breach, non-payment, legal requirement, serious security risk or discontinuation of the service.
When the agreement ends, public access and account features may stop. Provisions that by their nature should survive - including payment obligations, intellectual property, liability, dispute and lawful retention provisions - continue to apply.
17. Consumer rights, warranties and liability
Nothing in these Terms excludes rights that cannot lawfully be excluded, or liability for fraud, wilful misconduct, gross negligence, death or personal injury where such exclusion is prohibited. Consumers retain mandatory guarantees and remedies under the law of their country.
For business users, to the fullest extent permitted by law, OrbitPage is not liable for indirect or consequential loss, lost profit, lost opportunity or loss caused by content, integrations, domains or credentials controlled by the user. Each party must take reasonable steps to limit avoidable loss.
18. Governing law and disputes
These Terms are governed by Italian law, without depriving consumers of mandatory protections available in their habitual country of residence. The competent court is determined by applicable mandatory rules. Before starting formal proceedings, both parties should attempt in good faith to resolve the issue through contact@orbitpage.com.
19. Changes to these Terms
OrbitPage may update these Terms for legal, security, operational or product reasons. Material changes will be announced through the service or by email with reasonable notice where required. Continued use after the effective date means the updated Terms apply, except where fresh consent is required by law.
