The agreement for using the OrbitPage website and managed hosted service.

These Terms form an agreement between you and Paolo Ronco, operator of OrbitPage from Italy. By creating an account, starting a subscription or using the managed service, you accept these Terms together with the Acceptable Use Policy and, for paid plans, the Billing & Cancellation Policy.
If you use OrbitPage for an organisation, you confirm that you have authority to bind it. If you do not accept these documents, do not use the managed service.
2. Managed service and open-source edition
Managed OrbitPage provides account administration, an editor, hosted publishing, storage, plan controls, security, analytics, newsletters and custom-domain features according to the active plan. The open-source OrbitPage application is separate and is licensed under the MIT licence in its public repository. These Terms do not replace that software licence or make OrbitPage responsible for independent self-hosted deployments.
3. Eligibility and accounts
You must be at least 18 years old or otherwise legally able to enter this agreement. You must provide accurate information, verify your email when requested, protect your sign-in method and promptly report suspected unauthorised access. You are responsible for activity performed through your account unless caused by OrbitPage's breach of duty.
Usernames and hosted slugs are allocated on a first-confirmed basis, must be unique and may not impersonate another person, misuse a protected name or violate the Acceptable Use Policy. OrbitPage may reserve or reassign names where legally required, needed for platform operation or necessary to resolve a documented rights dispute.
4. Your content and licence to operate the service
You keep ownership of content you submit. You grant OrbitPage a worldwide, non-exclusive, royalty-free licence to host, copy, transform for technical delivery, cache, display and transmit that content solely to operate, secure and improve the service and to comply with your publication instructions. The licence ends when the content is deleted, subject to backups, caches, legal retention and copies made by third parties.
You confirm that you have all rights, permissions and lawful bases needed for your content, media, personal data, trademarks, links, embeds and connected domains. You remain responsible for statements and offers made on your page.
5. Public pages and third-party integrations
Published pages are intentionally public and may be indexed, shared and cached. External links, embeds, maps, analytics or media services can send visitors to third parties or cause those third parties to process data. You are responsible for selecting lawful integrations and providing visitor notices or consent where required.
Custom domains depend on your registrar, DNS configuration and Cloudflare's certificate and hostname validation. OrbitPage cannot guarantee a domain that you do not control or a specific propagation time.
6. Plans, limits and changes
Each plan can limit blocks, upload size, storage, themes, analytics, branding, collaborators, domains, newsletter subscribers, monthly email attempts, moderation checks and other resources. The limits shown on the pricing page, at checkout or in the dashboard form part of the service. OrbitPage may reject, compress, remove or prevent data that exceeds the active plan.
OrbitPage may change or retire features and plan limits to improve the service, respond to security or legal requirements, or keep the service economically sustainable. Material adverse changes to a paid plan will be communicated in advance where reasonably possible. Mandatory consumer rights remain unaffected.
7. Newsletters and customer SMTP
Paid newsletter features require an SMTP account that you are authorised to use. You are responsible for its availability, charges, sending limits, sender-domain authentication and provider terms. OrbitPage encrypts the submitted password and uses it only to verify the connection and send messages you configure.
You must have a lawful basis for every recipient, keep evidence of consent where required, identify the sender accurately and honour unsubscribe requests. Do not use purchased, scraped, guessed or stale lists. Generic SMTP acceptance does not guarantee inbox delivery; open and click reports are approximate because privacy tools and automated scanners can affect them.
8. Paid subscriptions
Paid plans are billed through Stripe at the price, currency, billing interval and tax treatment shown before checkout confirmation. Monthly subscriptions renew automatically until cancelled. Stripe stores and processes payment credentials; OrbitPage receives subscription, invoice and payment status rather than full card details.
Plan changes, payment methods, invoices and cancellation are managed through the dashboard and Stripe Customer Portal. Cancellation normally takes effect at the end of the current paid period. Refunds, failed payments and EEA consumer withdrawal rights are described in the Billing & Cancellation Policy.
9. Acceptable use and reports
You must comply with the Acceptable Use Policy. In particular, do not use OrbitPage for unlawful content, abuse, fraud, malware, rights infringement, deceptive impersonation, unauthorised security testing, spam or evasion of technical and plan limits.
Anyone may report suspected unlawful or prohibited content through the contact page. Reports should identify the exact URL, explain the concern and include enough information for review.
10. Moderation, suspension and appeals
OrbitPage may use automated and manual checks and may block publication, remove content, restrict a feature, suspend a public page or terminate an account where reasonably necessary to enforce these Terms, protect users or infrastructure, respond to a credible rights claim or comply with law.
Where appropriate, OrbitPage will consider the severity, context, history and risk of harm and may provide notice and an opportunity to remedy. Urgent action can be taken without advance notice. Account holders may contest a decision and request human review by contacting contact@orbitpage.com.
11. Intellectual property
OrbitPage's hosted platform, service design, brand, documentation and non-open-source components are protected by intellectual-property law. Except for rights expressly granted by the applicable open-source licence, you may not copy, resell, reverse engineer, remove notices from or create misleadingly branded versions of the managed service.
12. Third-party services
The service depends on providers including Firebase, Vercel, Cloudflare and Stripe. Their independent services and external websites are governed by their own terms. OrbitPage is responsible for selecting and managing its processors as required by law, but is not responsible for third-party content or for failures entirely outside its reasonable control.
13. Availability and changes
OrbitPage is provided on an as-available basis without a guaranteed uptime service level unless a separate written agreement says otherwise. Maintenance, security work, provider incidents, internet failures and events beyond reasonable control can affect availability. OrbitPage may release, test or withdraw features while preserving paid access and mandatory rights as required by law.
14. Ending the agreement
You may stop using the service and cancel a paid subscription at any time. You may permanently delete the account and hosted workspace from Dashboard > Account after confirming your identity. This removes the public page and slug, stored content and uploads, connected domain route, active Stripe customer relationship and Firebase login. Export a backup first if you intend to transfer the page to another account. OrbitPage may terminate the agreement for a material or repeated breach, non-payment, legal requirement, serious security risk or discontinuation of the service.
When the agreement ends, public access and account features may stop. Provisions that by their nature should survive - including payment obligations, intellectual property, liability, dispute and lawful retention provisions - continue to apply.
15. Consumer rights, warranties and liability
Nothing in these Terms excludes rights that cannot lawfully be excluded, or liability for fraud, wilful misconduct, gross negligence, death or personal injury where such exclusion is prohibited. Consumers retain mandatory guarantees and remedies under the law of their country.
For business users, to the fullest extent permitted by law, OrbitPage is not liable for indirect or consequential loss, lost profit, lost opportunity or loss caused by content, integrations, domains or credentials controlled by the user. Each party must take reasonable steps to limit avoidable loss.
16. Governing law and disputes
These Terms are governed by Italian law, without depriving consumers of mandatory protections available in their habitual country of residence. The competent court is determined by applicable mandatory rules. Before starting formal proceedings, both parties should attempt in good faith to resolve the issue through contact@orbitpage.com.
17. Changes to these Terms
OrbitPage may update these Terms for legal, security, operational or product reasons. Material changes will be announced through the service or by email with reasonable notice where required. Continued use after the effective date means the updated Terms apply, except where fresh consent is required by law.
